TVA loses appeal of EPA edict on plants

An Environmental Appeals Board upheld the EPA's order requiring TVA to bring eight of its oldest coal-fired plants up to current clean air standards, rejecting TVA's claim that maintenance work constituted routine repair. Dr. Stephen Smith of the Southern Alliance for Clean Energy praised the ruling as validation that TVA violated the Clean Air Act, while TVA officials indicated they would pursue further court appeals despite the decision.

These old, dirty coal-fired plants are public enemy number one for clean air and the Smoky Mountain National Park. This ruling clearly shows that TVA has violated the Clean Air Act by failing to reduce emissions when they are doing work to extend the life of these facilities.
