Ruling allows TVA to ignore cleanup order for old plants

A federal appeals court ruled that TVA can temporarily ignore EPA cleanup orders for coal-fired power plants pending proof of Clean Air Act violations in district court. Stephen Smith, director of the Southern Alliance for Clean Energy, criticized the decision for failing to address the substance of the case and called for federal intervention to address TVA's coal plant operations. The ruling delays pollution control improvements at TVA plants near Nashville, Knoxville, and the Great Smoky Mountains National Park.
The question is now, how do you bring TVA to justice for violating the law? I think the answer is for the administration to step in and send a clear message to TVA about what they want to do with their coal plants.
