North Carolina plans to sue TVA over pollution

North Carolina's attorney general announced plans to sue the Tennessee Valley Authority over emissions from coal-fired power plants in Tennessee, Alabama, and Kentucky, citing violations of New Source Review standards and the need for stricter pollution controls. TVA defended its compliance record and emissions reduction efforts, while Stephen Smith of the Southern Alliance for Clean Energy supported the lawsuit but called for more aggressive action from TVA.
We applaud this action by North Carolina. Unfortunately, the merits of the case against TVA for New Source Review violations have never been tried and got caught up in the legal wrangling between two federal agencies. TVA is making improvements, but it needs to do much more.
