High court refuses to review TVA case

In this mention

The U.S. Supreme Court refused to review a lower court ruling that allowed TVA to ignore EPA orders to reduce air pollution from its coal-fired power plants. Stephen Smith of the Southern Alliance for Clean Energy criticized the decision, arguing that TVA should not receive preferential treatment compared to investor-owned utilities facing similar Clean Air Act enforcement actions. The ruling leaves uncertain what future enforcement actions the Justice Department and EPA will pursue against the federally owned utility.

Why should TVA get off the hook if Southern, AEP and other investor-owned utilities are having to meet these new source standards?

Stephen A. Smith
