EPA Loses Clean Air Case against TVA

In this mention

The U.S. Supreme Court declined to review an EPA enforcement action against TVA over New Source Review violations, effectively ending the Clinton administration's retroactive interpretation of Clean Air Act requirements. Stephen Smith of the Southern Alliance for Clean Energy expressed disappointment, stating the case was among the strongest filed against utilities and that EPA must start over. The ruling underscores the Bush administration's decision to clarify NSR interpretation consistent with pre-Clinton standards.

The case against TVA was one of the strongest of those filed in 1999 against all of the utilities. We're back to ground zero, and EPA has got to start all over again, if they're going to start at all.
