The Southern Environmental Law Center, acting on behalf of four environmental groups,
is asking N.C. regulators to rescind the air-quality permit for the proposed coal-fired unit at
Duke Energy Corp.'s Cliffside complex.

The Charlottesville, Va.-based law center filed its petition against the N.C. Division of Air
Quality on behalf of the Environmental Defense Fund, Southern Alliance for Clean Energy,
National Parks Conservation Association and Sierra Club.

The Cliffside complex is on the Cleveland-Rutherford county line.

Regulators granted Duke an air-quality permit for the 800-megawatt coal unit on Jan. 29.
Charlotte-based Duke (NYSE:DUK) began construction at the site the next day.

Opponents contend the permit would allow the use of outdated coal technology and contribute
to global warming, smog, soot and mercury pollution.

Duke contends the controls required by the permit are more stringent than those mandated by
the Environmental Protection Agency.
